Civil and family law


1.   The Office provides services in the following areas of civil law:

–   representation of parties  in judicial proceedings,

–   drafting pretrial documentation, such as statements, agreements, legal opinions,

–   key legal issues include:

   protection of personal interests,

   defects of declaration of intent,

   exceeding the scope of empowerment (by attorney),

   establishment of the right of way (by necessity),

   marking out land (immovable property),

   acquisitive prescription,

   remuneration for non-contractual using a thing (without legal title),

   severance of co-ownership,

   utility servitude,

   infringement of Possesion,

   claims by securitization funds,

   issues concerning succession,

–   overall assistance and consulting on issues reading civil law relations, including oral and written opinions,

–   assistance in drafting and negotiation of the content of agreements, legal advice concerning the content of contracts and  agreements

–   issues concerning claims for damages and compensation

–   issues concerning obligations – pecuniary and no-pecuniary claims to be pursued, protection against wrongful claims, and civil law partnerships

–   issues concerning contractual claims regarding contracts of sale, contracts of lease, contracts of mandate, and project contracts,

–   issues concerning immovable properties, cooperatives and premises.


2.   The Office also provides services in the following areas of family law:

–   divorce and separation,

–   distribution of property (possesion gained),

–   establishment of material separation,

–   maintenance obligation,

–   parental authority, i.e. suspension or deprivation of parental authority, contact with a child,

–   adoption,

–   recognition and denial of paternity/maternity,

–   (ineffectiveness of) recognition of a child,


3. The Office’ services as well include issues concerning labour law and social insurance system, such as:

–   consulting all aspects of employment (individual and collective labour law),

–   representation of employees and employers before courts and administrative authorities,

–   legal aid for employees within the scope of: claims regarding: determination of the existence of an employment relationship, damages, remuneration, and appeal against termination of an employment contract (reinstatement to work),

–   legal aid for employers, as follows: preparing (with expertise if need be) employment documentation, regulations (eg. work regulations, remuneration regulations, corporate rights and obligations),

–   preparation and expertise on contracts and agreements (such as employment contracts, management contracts, prohibition on competition and other).
